TERMS AND CONDITIONS OF THE ONLINE STORE OF THE DWORK PRZY LESI

§1. General provisions

1. These regulations ("Regulations") define the rules for using the online store operated by Dworek Przy Lesie Sp. z o. o. at the address https://dworekprzylesie.com.pl.

2. The seller is:
MANOR AT THE FOREST LIMITED LIABILITY COMPANY

with its registered office in Zimnodół (32-300 Zimnodół, ul. Zimnodół 96A),
entered into the Register of Entrepreneurs maintained by District Court for Kraków Śródmieście in Kraków, 12th Commercial Division of the National Court Register, under the number KRS 0000808759, NIP: 6751715487, REGON: 384620570, with a share capital of 5,000 PLN.

4. The Regulations are available free of charge on the store's website, and each Buyer has the opportunity to read them before placing an order.
5. The store conducts retail sales via the Internet.
§2. Definitions

1. Store – website available at https://dworekprzylesie.com.pl, enabling the purchase of tickets and other products offered by the Seller.

2. Seller / Administrator – DWOREK PRZY LESI Sp. z o. o.

3. Buyer / Customer – an adult natural person, legal person or organizational unit making a purchase in the Store.

4. Product – ticket, voucher or other service available in the Store.

5. Order – a declaration of intent of the Buyer submitted via the order form on the Website, aimed at concluding a Product sales contract.

6. Payment operator – system Przelewy24 handling electronic payments.

§3. Technical conditions
1. To use the Store, you must have a device with Internet access, a web browser, and an active email address.
2. Creating an account is not required to make a purchase – purchases can be made as a guest.
§4. Placing orders
1. Orders are accepted 24 hours a day, 7 days a week, via the website.
2. To place an order, the Buyer selects a Product, completes the order form, provides contact details and makes payment.
3. Placing an order constitutes acceptance of these Regulations.
4. After placing the order, the Buyer receives a purchase confirmation and – in the case of tickets – an electronic ticket to the provided e-mail address.
5. The sales contract is concluded upon confirmation of acceptance of the order by the Seller.
§5. Prices and Payments
1. All prices are given in Polish zloty (PLN) and include all applicable taxes.

2. The buyer has the option of making a payment via the system Przelewy24, supporting online transfers, card payments or Blik.

3. Failure to receive payment by the Seller within 24 hours of placing the order may result in the order being canceled.
§6. Order Fulfillment
1. The order will be processed after payment confirmation.
2. Electronic products (e.g. tickets, vouchers) are sent electronically to the e-mail address provided by the Buyer.
3. The Seller is not responsible for incorrect data entered by the Buyer (e.g. incorrect e-mail address).
§7. Event Cancellations and Refunds
1. If the Organizer cancels the event, the Buyer is entitled to a full refund of the ticket price.
2. In the event of a change in the event date, the Buyer has the right to:
a) accept the new date, or
b) withdraw from the contract and receive a refund.
3. Refunds will be made using the same method used to make the payment.
4. In the case of electronic products, in accordance with Article 38, point 12 of the Consumer Rights Act, the right to withdraw from the contract does not apply if the Product relates to an event occurring on a specific date.

§7a. Right of withdrawal

1. The Customer who is a consumer has the right to withdraw from the distance contract without giving any reason, on the basis of Article 27 of the Act of 30 May 2014 on consumer rights, within 14 days.

2. The deadline for withdrawal from the contract runs:
a) from the date of conclusion of the contract – in the case of services,
b) from the date of receipt of the Product – in the case of electronic products made available for download or use.

3. In accordance with Article 38 of the Consumer Rights Act, right of withdrawal not entitled in relation to:
a) services related to entertainment events, if the contract provides for a specific day or period of performance (Article 38, point 12),
b) services fully performed before the expiry of the withdrawal period with the express consent of the consumer (Article 38, point 1),
c) the supply of digital content, if the performance of the service began with the express consent of the consumer before the expiry of the withdrawal period and after informing him of the loss of this right (Article 38, point 13).

4. In order to exercise the right to withdraw from the contract, the Customer should send a declaration of withdrawal to the following e-mail address: manager@dworekprzylesie.com.pl, in any form, including using the template form available in Annex 1 to these Regulations.

5. The Seller will immediately confirm receipt of the declaration of withdrawal.

6. The Seller will refund the payment in accordance with Article 32 of the Consumer Rights Act, no later than 14 days from the date of receipt of the declaration of withdrawal from the contract. The refund will be made using the same payment method used by the Customer, unless the Customer expressly agrees to a different solution.

7. If the Customer has requested the commencement of the provision of the service before the expiry of the withdrawal period and then exercises the right of withdrawal, he is obliged to pay for the services provided until the time of withdrawal - in accordance with Article 35 of the Consumer Rights Act.

§8. Complaints

1. The Buyer may submit complaints regarding the operation of the Store or purchased Products electronically to the following address: manager@dworekprzylesie.com.pl.

2. The complaint should include the Buyer's details, order number and description of the problem.
3. The Seller will consider the complaint within 14 days of its receipt.
§9. Personal data protection
1. The administrator of the Buyers' personal data is DWOREK PRZY LESIE Sp. z o. o.
2. Personal data are processed for the purposes of contract execution, payment processing, contact with the Buyer and compliance with legal obligations.

3. Detailed rules for the processing of personal data are described in Privacy Policy available on the Store's website.

§10. Final provisions
1. The Seller reserves the right to make changes to the Regulations, which are effective from the moment of their publication on the website.
2. In matters not regulated herein, the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.
3. The Regulations are effective from the date of their publication on the Store's website.
